Below we have outlined the basic steps we take in pursuing
an accident & injury case. However, remember that each case is unique and may
require additional or different actions to ensure that you get the best representation
possible.
1. Get appropriate medical treatment
Our first priority at Tobler & Associates is to make sure that our clients
get the medical treatment that they need. If you have not already seen a doctor,
chiropractor, or other healthcare professional, then we will refer you to
one. We encourage clients to see their medical providers consistently and
to complete their full course of recommended treatment.
2. Notify the adverse insurance company
As soon as we agree to take your case, we will notify the adverse insurance
company and any other necessary party that we are representing you. This ensures
that they communicate directly with us regarding your case, and that they
do not harass you.
3. Gather records and submit a demand package
Once you have finished treating and have physically recovered to the fullest
extent possible, we will collect your medical records, wage loss records,
and any other pertinent records. We will prepare a demand package that includes
those materials as well as a discussion of the facts, the legal argument for
liability, photographs, and an initial offer of settlement. We submit the
demand to the opposing side and begin the negotiation process.
4. Settle or go to trial
During the negotiation process, the majority of our accident & injury
cases settle. Sometimes, to assist in reaching a settlement, we will participate
in arbitration, mediation or other alternative dispute resolution procedures.
However, if both sides are unable to reach an agreement, we will file suit
and take the case to trial. After trial, sometimes it is necessary to defend
or file an appeal.
